When solving a case that is the daily business of a lawyer, fact-checking is the most important point. Step 1 is to not listen to the problem and come to a conclusion or solution. Find a relevant fact, then analyze the reason, then analyze the factor, then propose a solution. This can be achieved through basic skills such as fact-finding, active listening, and listening with filtering. Making a problem worse to solve it may seem counterintuitive, but it`s a great way to test your theories about the underlying cause. Can you replicate the problem by intentionally triggering the circumstances that you think are causing it? Essays are designed to critically analyze the law and the academic opinion associated with it, and to throw your own thoughts into a form of written debate. Problematic issues, on the other hand, are not a verbal battle of opinions, but a structured application of the law to a set of facts. In other words, your goal is not to discuss whether a law is good or bad, but to advise a fictitious client about their legal responsibilities. The RAIC methodology is useful in helping you organize your legal analysis so that the reader can follow your reasoning. It is particularly useful for writing answers to questions of legal problems and legal notes.
To put it in context, we dive deep into the current state of the legal profession to understand the range and scope of service delivery challenges facing the entire spectrum, from access to justice challenges to major legal battles and everything in between. Then, within each of these “problems,” we should be able to identify the sub-problems to which we apply the RAIC method. For example, you may need to analyze whether Harry has a duty of care or has defences available, in which case you should make a statement of the law and apply it to the facts before drawing a conclusion on this sub-issue. The Capstone Design Challenge serves to bring together the different elements of understanding and experimentation, and relies heavily on the collaboration and communication skills that are essential to solving real-world problems. I think problematic issues are great if you have a system or process to solve them, so I`ll break down the article like this. Ultimately, students will understand and be able to apply human-centered design (mindsets and processes) and related tools to think and be curious like a client and creatively solve legal and client service challenges while creating a personally rewarding and sustainable legal career. Understanding the problem also includes analyzing what will be the cause of such a problem, what went wrong in the first place? What additional circumstances have been added to raise the level of a problem? This will help give the direction to solve the problem because you know what factor went wrong. By patient, I don`t mean finding a solution to the problem.
