Our land rights management department was represented by Lelethu Mgedezi and Sindile Dlamini, who spoke about Legal Aid SA`s new mandate to help with land justice and how we can help agricultural workers and residents. Our client was charged with theft from a motor vehicle and possession of car breakdown equipment. It was alleged that the accused and another person stole a spare tire from an unmarked police vehicle. Our client was arrested as he drove past the police station with his spare wheel. The other person could not be found and the defendant was alone in court. Apparently, the other person had admitted to stealing the spare tire. Kamogelo challenged the constitutionality of the arrest, in particular the fact that the accused had not been given an opportunity to explain himself and that his rights had not been explained. Kamogelo also downplayed the witness` identification that the wheel came from the police vehicle. Our client was found not guilty.
