If a person marries while suffering from a mental illness or incapacity, such that they cannot give legal consent to the marriage, there may be grounds for annulment. Such a marriage is questionable. A valid marriage requires a contractual intention. A person with mental illness, mental illness or severe mental disability may not have the legal capacity to enter into a marriage contract. The mental capacity of the person at the time of marriage is decisive, not the state of mind before marriage or the state of mind at a later time after marriage. ¶ 2 Guadagni was charged with bigamy, a fifth-grade felony, in violation of Art. 13-3606(A) of the A.R.S.   The state presented evidence in court showing that Guadagni Gail D. was arrested on September 4. On September 1, 2000, he attended a wedding ceremony with Sarah W. while he was still married and living with Gail.

  Guadagni and Sarah had received a marriage certificate from Pima County Superior Court earlier that day, and both signed it after a solemn ceremony in Reid Park. The authorized minister who presided over the ceremony also signed the licence, as did two witnesses.   The Minister then licensed Guadagni and Sarah at their request.   Neither Guadagni nor Sarah ever took the license. BELLY: Not quite. The most intense part of the law in Utah only went into effect last year. The Browns left after a bigamy review before that happened. But they spoke very publicly on the show about how they believe this law is harmful, and they even went to Utah to attend a protest in front of the state Capitol that they feared might risk being arrested when they weren`t.

We note that the Arizona Child Bigamy Act, A.R.S. § 13-3609(A), (D)(1), authorizes prosecution for a “marriage” in which no marriage certificate has been “issued.”  ¶ 12 Having concluded that the state does not have to prove that a marriage certificate was registered to prove that a person “knowingly married” in violation of Article 13-3606(A), we reject Guadagni`s contention that the state failed to provide sufficient evidence of his guilt.   Guadagni does not deny that he was married to Gail at the time he attended a wedding ceremony with Sarah and that his marriage to Gail was valid.   The state presented evidence that Guadagni and Sarah jointly received a marriage certificate, exchanged vows in the presence of a minister and two appropriate witnesses, and signed their names on the license.   So Guadagni and Sarah did everything legally required of them to marry, if not for his continued marriage to Gail. Guadagni and Sarah were reportedly legally married because of their ceremony in Reid Park.   Guadagni claims that at the time of the ceremony, he did not intend to marry Sarah, as evidenced by the fact that he did not return the license to the official to have it registered.   But even assuming that the state was required to demonstrate such intent, see § 13-3606(A) (the mindset for the crimes is “knowing”), the jury could reasonably infer such an intention from its participation in the witness ceremony and the execution of the license.   Since there was substantial evidence that Guadagni married Sarah while he was still married to Gail, the trial court did not abuse its discretion in dismissing Guadagni`s request for acquittal. The short answer is that Kody has only one legal wife, and he is bound to the other women in his polygamy by a spiritual union.

Meri, Kody`s first wife, was his legal wife until 2014, when she and Kody divorced so he could legally marry Robyn and adopt the children Robyn had from a previous relationship. In 2013, two years after the Sister Wives stars sued Utah and the Utah County District Attorney`s Office over the state`s bigamy law, a federal judge in Utah overturned the ban on “cohabitation” but upheld the ban on bigamy “literally – fraudulent or otherwise improper possession of two allegedly valid marriage licenses for the purpose of contracting more than one allegedly legal marriage.” as CNN reported at the time.
